Algunas propuestas para una futura ley de cooperación jurídica internacional en materia civil

Los particulares también pueden invocar el derecho a la tutela judicial efectiva cuando
sus relaciones jurídico privadas presentan algún elemento internacional. En estos supuestos, tan
importante es poder acudir a los tribunales españoles como confiar en que éstos podrán reconocer
las sentencias dictadas en el extranjero o saber que las autoridades españolas colaborarán con las
autoridades judiciales extranjeras cuando el proceso se desarrolle en otro país. Ciertamente la
intensidad en la colaboración entre autoridades depende del grado de confianza existente entre
los Estados. Así, en espacios integrados la cooperación es máxima. Pero incluso cuando dicha
integración no existe, el art. 24 CE obliga al legislador a procurar esa cooperación jurídica internacional,
aunque con ciertos límites constitucionales. Con estas premisas se proponen algunas
pautas para una futura ley de cooperación que tenga en cuenta el entramado existente de normas
y cubra las actuales lagunas del sistema Access to justice is a fundamental right also when the parties are involved in a transfrontier
relationship. Thus, access to national courts is as fundamental as the right to have a
foreign judgment recognized in the forum. An adequate system of judicial cooperation in civil
matters between authorities is also necessary both as the proceedings are pending at the forum
(i. e. searching for evidence abroad) or when the foreign authority seeks for cooperation in a
proceeding the result of which is likely to be recognized or enforced in the forum. The more trust
there is among States, the higher the degree of cooperation. Thus, the maximum collaboration
will be reached between States in integrated areas. However, even in default of such integration,
the State is obliged to provide for such cooperative behaviour within certain constitutional limits.
Any future text which tackles this issue should be built upon these ideas and should endeavour to
offer a complete system which fulfils the present lacunae in the Spanish legal order
