La polisemia de ius, iuris (‘derecho’, ‘aderezo’) y la idea genuina (‘unión’) del Derecho Romano

Ius, iuris (‘derecho’ y ‘salsa’) fue en principio una sola palabra de la misma raíz de iungere (‘unir’). Del significado ‘unión’ que tenía en la lengua común evolucionó a los dos empleos técnicos conservados en época histórica. Creemos que esta hipótesis se apoya en criterios metodológicos claros y en argumentos sólidos. Por ello, no es procedente rechazarla por motivos fonéticos que no se sostienen o por supuestas dificultades semánticas. Si se presta atención a la diferencia entre lengua común y lengua especial, al sentido instrumental con que se tecnifica el empleo de uno y otro ius, al carácter oral del ius jurídico y a las numerosas analogías de las fórmulas jurídica, culinaria e incluso médica en diferentes lenguas, la unidad etimológica de ius parece obvia. Ius, iuris ('law' and 'sauce') was originally one word from the same root as iungere 'to join together'). From the meaning 'union' that it had in ordinary language, it evolved into the two technical usages that are conserved in historical times. We believe that this hypothesis is supported by clear methodological criteria and by sound arguments. Because of this, we should not reject it for tenuous phonetic reasons or because of supposed semantic difficulties. If attention is paid to the difference between ordinary and special language, to the instrumental sense with which each meaning of ius develops into a technical term, the oral character of the legal ius and to the numerous analogies between legal, culinary and even medical formulae in different languages, the etymological unity of ius seems obvious.
