dc.description.abstract | In a QPC ruling dated from 4th April 2013, the French constitutional court – the Conseil
constitutionnel – made its very fi rst preliminary reference to the European Court of Justice
regarding the interpretation of one of the dispositions of the Framework Decision establishing
the European Arrest Warrant. Actually, several reasons can explain this “extraordinary” decision.
First of all, the general context of a certain alignment of the French constitutional system with
the European legal order that gave the opportunity to the constitutional court to fi nally cross that
legal Rubicon. Secondly, the will for the Conseil to end the process of its “jurisdictionalization”
through this inter-jurisdictional dialogue. The present article revisits this important QPC ruling
and tries to stress not only its legal grounds but also the main consequences of such a decision | en_US |
