En la segunda parte se estudia la posición del Ministerio Fiscal en el proceso penal y si la figura de un fiscal investigador garantizaría la imparcialidad de la justicia penal In the following article we tackle the study of the Attorney General’s office as an organ of constitutional relevance to fi nd out if it has true autonomy when facing the powers of the state, in truth the government. To achieve that we analyze the principles which regulates its acts, that is to say, legislation, impartiality, unity in interventions and hierarchical dependency, as in the crucial form of the naming and the cessation/ dismissal of the Attorney General. The second part is focused on the standing of the Attorney General´s office in the penal process and if the figure of the State Prosecutor can warrant the impartiality of penal justice
