La publicità nei documenti paleo-babilonesi di alienazioni immobiliari

The publicity has the aim of making possible the knowledge of acts or events, that produce legal effects, to
anyone in desire. This aim is especially important for the alienation of real estates, to enable the buyer to
know the legal status of what he wishes to buy. In Old Babylonian period the proper instruments for the
publicity were also formal requirements, i.e. the presence of witnesses (sometimes also officers, and often
they were neighbors) and the drawing up of a written, and also sealed, document. These elements could
mean that, during the Old Babylonian period, publicity was in an advanced stage of development, where it
provides certainty for the contracting and third parties, but it promotes also the sale of real estate producing
formal titles, that were more suitable for economic circulation. La pubblicità ha lo scopo di rendere possibile la conoscenza di atti o eventi produttivi di conseguenze
giuridiche a chiunque ne abbia desiderio. Tale scopo risulta particolarmente importante nell’ambito delle
alienazioni immobiliari, per permettere all’acquirente di conoscere la situazione giuridica di ciò che andrà
ad acquistare. Nel periodo paleo-babilonese gli elementi idonei a tale scopo sono anche requisiti formali:
la presenza dei testimoni (tra i quali possono annoverarsi anche pubblici ufficiali) e la stesura di un
documento scritto e sigillato. Questi elementi porterebbero a pensare che nel periodo antico-babilonese ci
troveremmo in uno stadio già avanzato della pubblicità, in cui essa è dettata dalla necessità di fornire una
“certezza per i contraenti e per i terzi”, ma anche da quella di “smobilizzo dei beni, attraverso la
costituzione di titoli formali, più rapidamente circolanti”.
