Ouvidodres e administraçâo da justiça no Brasil colonial: O caso da comarca da Paraíba (c.a. 1687-c.a.1799)

Abstract

O presente artigo é decorrente de uma pesquisa de doutoramento que se dedica a pensar a relação entre direito e justiça a partir do caso dos ouvidores da comarca da Capitania da Paraíba. No Brasil colonial, os ouvidores correspondiam a bacharéis de nomeação régia. Tinham como circunscrição jurisdicional a comarca e atuavam num nível intermediário entre os juízes ordinários e os Tribunais de Relação (Bahia e Rio de Janeiro), sendo um dos principais agentes responsáveis pela administração da justiça nesse espaço. A ouvidoria da capitania da Paraíba foi criada em fi nais do século XVII e, desde sua criação até o fi nal do século XVIII, vinte e dois magistrados passaram pela mesma. Propõe-se aqui verifi car o perfi l prosopográfi co (origens geográfi ca e social e carreira administrativa) desses bacharéis, procurando perceber semelhanças e/ou divergências com os padrões estabelecidos pela historiografi a para o império português

This article results from a doctoral research dedicated to legal history of the early modern period as from the case of the ouvidores of the Captaincy of Paraiba. In colonial Brazil, the ouvidores corresponded to judges appointment by the king. They had as jurisdiction the territory of comarca and worked at an intermediate level between ordinary judges and the Courts of Appeal (Bahia and Rio de Janeiro), being one of the main agents responsible for the administration of justice in this space. The ouvidoria of the Captaincy of Paraiba was established in the late seventeenth century and, since its creation until the late eighteenth century, twenty two magistrates have gone through the same. It is proposed here to analyze the prosopographical profi le (geographical and social backgrounds and career) of these graduates, seeking to understand similarities and/or diff erences with the standards set by historiography of the Portuguese empire
