Abstract
El presente trabajo analiza la protección de los Derechos humanos de las personas con
discapacidad en el ámbito del Derecho civil español. El interés por el tema surge porque en
la actualidad, la protección que les dispensa nuestro Código civil no se encuentra adaptada
a las exigencias de la Convención Internacional sobre los Derechos de las Personas con
Discapacidad (13 diciembre 2006), tal y como han sido interpretadas por su Comité (CDPD,
2014). También se examina el Anteproyecto de Ley por el que se reforma la legislación civil
y procesal en materia de discapacidad (21 septiembre 2018), con el objetivo de poder
formular propuestas de lege ferenda a la esperada y necesaria reforma del Código civil en
esta materia, que lleva más de doce años de retraso. This work analyses the protection of human rights of persons with disabilities in the area
of Spanish civil law. The interest of this issue arises due to the current protection provided
by our Civil Code, which is not adapted to the requirements of the International Convention
on the Rights of Persons with Disabilities (December, 13 of 2006) as interpreted by the by
the Convention’s Committee in their General Comment No. 1 of 2014. The draft bill aimed
to reform civil and procedural law on disability issues (21 September 2018) is also reviewed,
with the aim of being able to make proposals de lege ferenda to the expected and necessary
reform of the Civil Code in this matter, which has been delayed for more than twelve years.
