La separación de poderes es, al mismo tiempo, un principio del derecho público y un
dogma de contenido difuso. Se trata de una idea forjada para proteger de las libertades en los Estados
liberales de Derecho, cuya función era la contener al poder público. En el Estado Social
de Derecho, los mandatos de eficacia que lo caracterizan permiten preguntarse legítimamente si es la
separación de poderes un sistema adecuado no para limitar el poder público, sino para conducirlo
hacia la producción efectiva de resultados socialmente valiosos. La idealización de la separación de
poderes es entonces reemplazada por el real ejercicio multiorgánico del poder público, al tiempo
que el principio de separación entre las ramas del poder público (unitario), encuentra un alcance que evite la arbitrariedad, pero sin impedir la eficacia administrativa The Separation of Powers is, at the same time, a principle of public law and a dogma
of diffuse content. It is an idea forged to protect individual freedoms in the Liberal State, and
to help bring public power under the Rule of Law. In the Social State of Law, the mandates of
efficacy that characterize this principle allow to legitimately ask whether the Separation of Powers is an adequate system not just to limit power, but also to lead it towards the effective production
of socially valuable results. The idealization of the Separation of Powers could then be replaced
by a real multi-organ exercise of public power, where the principle of the separation between the
branches of public power (unitary), achieves a scope that avoids arbitrariness without impeding administrative
