Abstract
En este artículo se estudian los derechos del niño desde un punto de vista del Derecho Internacional. En un primer momento, se analiza la evolución histórica producida a lo largo del siglo XX hasta llegar a su punto álgido, protagonizado por la Convención de Naciones Unidas de 1989. Sin embargo, el que ha emergido como su elemento esencial (el interés superior del niño) apareció en la jurisprudencia por vez primera en el siglo XVIII. Tras detenernos en la Convención, estudiar el problema que plantea la posibilidad de formular reservar y profundizar en su contenido, el trabajo se centra en concretar el interés superior del niño, su relativismo, la relevancia del derecho a ser escuchado, así como su aplicación en ámbitos materiales distintos del derecho de familia, en el que apareció In this article, the focus is the rights of children from the point of view of International Law.
