Los ERTES no son una novedad de la pandemia porque ya tenían regulación anterior,
en una evolución normativa que incentivaba su utilización por las empresas durante las
crisis. La regulación específica y adaptada de ERTES durante la pandemia ha terminado
por consolidar su papel esencial en la flexibilidad laboral interna y confirmando su utilidad
como alternativa a los despidos. El protagonismo de la fuerza mayor en los ERTES de
la pandemia debe dejar paso ahora, en la transición y de manera estructural, a las causas
empresariales. El nuevo modelo estructural de ERTES va a convertir en permanentes las
técnicas de protección social de desempleo y liberación de costes a las empresas, utilizadas
en la pandemia, pero tendrá que hacerlo sobre la flexibilidad de estas causas empresariales,
la integración de la formación y vías innovadoras que garanticen la financiación pública
exclusiva a empresas viables The ERTES are not a novelty of the pandemic because they already had previous regulations,
in a normative evolution that encouraged their use by companies during crises. The
specific and adapted regulation of ERTES during the pandemic has ended up consolidating
its essential role in internal labor flexibility and confirming its usefulness as an alternative
to layoffs. The role of force majeure in the ERTES of the pandemic must give way now, in the
transition and structurally, to business causes. The new structural model of ERTES is going
to make permanent the techniques of social protection of unemployment and release of costs
to companies, used in the pandemic, but it will have to do so on the flexibility of these business
causes, the integration of training and ways innovative companies that guarantee
exclusive public financing to viable companies
