Abstract
Una Administración tributaria necesita disponer de datos o de información relativa a los contribuyentes. En estas líneas, abordaremos el equilibrio que debe existir hoy entre la potestad de obtención de información tributaria y el derecho a la intimidad, tanto en su vertiente estricta como en su manifestación de derecho a la protección de datos. Analizaremos esta cuestión desde la perspectiva del artículo 18 de la Constitución española, pero también desde la que da la doctrina construida sobre los artículos 7 y 8 de la Carta de Derechos Fundamentales de la Unión Europea y el artículo 8 del Convenio Europeo para la Protección de los Derechos Humanos y de las Libertades Fundamentales, acudiendo a la jurisprudencia tanto del Tribunal de Justicia de la Unión Europea como del Tribunal Europeo de Derechos Humanos The tax authorities need to have data or information on taxpayers. Along these lines, we will address the balance that must exist today between the power to obtain tax information and the right to privacy, in the strict sense and as an expression of the right to data protection. We will analyze this issue from the perspective of article 18 of the Spanish Constitution. We will also bear in mind the doctrine built on articles 7 and 8 of the Charter of Fundamental Rights of the European Union and article 8 of the European Convention for the Protection of Human Rights and of Fundamental Freedoms, using the case law of both the Court of Justice of the European Union and the European Court of Human Rights
