Fundamento dogmático de la agravación por reincidencia

Abstract

La repetición delictiva por parte de personas que ya han sufrido una pena genera, sin duda, complicaciones a muchos niveles: social, mediático y, por supuesto, jurídico. La incapacidad estatal para reducir la reincidencia ha desembocado, tradicionalmente, en el recurso a la agravación de la pena. En la actualidad, debido al incremento de las medidas de seguridad en nuestro ordenamiento, se plantea también si tales medidas pueden ser de utilidad en este campo. Resulta clara, por tanto, la mayor intensidad en la respuesta penal para los autores reincidentes. Sin embargo, creo necesario plantear si tal intensidad en el tratamiento a este tipo de autores puede ser compatible con los principios jurídicos que deben guiar nuestra legislación. En el artículo trato de demostrar la tensión entre los principios dogmáticos generalmente defendidos y el tratamiento efectivamente impuesto a los reincidentes.

The criminal repetition by people who have already gone through the state penal apparatus generates, undoubtedly, complications on many levels: on the social level, regarding the media and, of course, legal issues. The inability of the state to reduce recidivism has traditionally led to a resource of aggravated punishment. Currently, due to increased “security measures” in our legal system, also raises the question of whether these measures can be useful in this matter. It is clearly more intense the response to the “reoffenders”. However, I need to ask if such intensity in the treatment for this type of criminal perpetrators may be consistent with the principles that should guide our legislation. In this article I try to show the tension between the generally defended principles and the effectively treatment imposed to repeating offenders.
