Regular o trabalho, evitar opressâo: O Direito português entre a metrópole e as provincias ultramarinas metade do século XIX

Abstract

O texto apresenta a regulação inovadora do trabalho no Direito português, na segunda metade do seculo XIX, no contexto operário europeu e no contexto agrícola colonial. Visa dar a conhecer –em Portugal e nos territórios ultramarinos– a substituição da escravatura pelo trabalho forçado e os novos caminhos do trabalho livre, «fugindo» dos esquemas puramente civilistas e preparando a construção de um novo ramo, o Direito do Trabalho. A compreensão histórica destes fenómenos levanta questões pertinentes, que podem auxiliar na dilucidação de conceitos jurídicos como os de «subordinação jurídica», «obediência», «poder de direcção» ou «poder disciplinar». O novo Direito que começava a nascer convocava «novos» princípios e conceitos que merecem refl exão crítica, capaz de questionar a sua confi guração contratual e a proximidade com formas de sujeição do Direito antigo. Contudo, a nova regulação, integrando e legitimando essa subordinação, pretendia também limitá-la e garantir a liberdade daquele que contratava obedecer

This paper describes the innovative way in which labour was regulated in Portuguese law in the second half of the 19th century in the context of the European labour movement and colonial agriculture. It focuses on the replacement of slavery by forced labour in Portugal and the overseas territories, and the steps that were taken towards a conception of free labour, outside purely civilist schemas, and the preparations for the construction of a new branch, Labour law. The historical understanding of these phenomena raises some pertinent questions, which can help clarify certain legal concepts such as ‘legal subordination’, ‘obedience’, ‘management power’ and ‘disciplinary power’. The new law that was emerging invoked ‘new’ principles and concepts that require critical refl ection, given their contractual confi guration and proximity to forms of subjection from the previous law. However, the new regulation, which included and legitimized this subordination, also aimed to limit it and ensure the freedom of those that were contracted to obey
