Abstract
Observando la DUDH verificamos que todas las personas nacen libres y iguales en dignidad
y derecho; son dotadas de razón y conciencia y deben actuar en relación unas a otras con
espíritu de fraternidad. En virtud de la Convención sobre los Derechos del Niño,
constatamos que todos los niños tienen derecho a conocer a sus padres y a preservar su
identidad. Teniendo en cuenta la Constitución de la República Portuguesa, se apura que
Portugal es una República soberana basada en la dignidad de la persona humana que
reconoce el derecho a la identidad personal y desarrollo de la personalidad, lo que implica el
conocimiento de la identidad de los padres. Todos estos preceptos legales plantean algunos
problemas en relación a la procreación médicamente asistida (PMA) debido al carácter
confidencial del proceso postulado en la Ley nº 32/2006, de 26 de julio. Sin embargo, se
requirió al Tribunal Constitucional la declaración de la inconstitucionalidad de dicho
artículo, por violación de los derechos mencionados y del principio de la dignidad humana.
Así, a través de esta investigación proponemos analizar los fundamentos de la decisión del
Tribunal que declara el fin del anonimato en la PMA y reconoce el derecho al conocimiento
de los orígenes genéticos, para demostrar que la dignidad de la persona humana es un
principio absoluto Observing the UDHR we find that all people are born free and equal in dignity and right;
are endowed with reason and conscience and must act in relation to one another in a spirit
of brotherhood. Under the Convention on the Rights of the Child, we find that all children
have the right to know their parents and to preserve their identity. In view of the
Constitution of the Portuguese Republic, we find that Portugal is a sovereign Republic
based on the dignity of the human person and that the right to personal identity and the
development of the personality is recognized, which implies knowledge of the identity of
the parents. All these legal precepts raise some problems regarding medically assisted
procreation (PMA) due to the confidential character of the process postulated in Law no.
32/2006, of July 26. However, the Constitutional Court was required to declare the article
unconstitutional, for violation of the aforementioned rights and the principle of human
dignity. Thus, through this investigation, we propose to analyze the grounds of the Court's
decision declaring an end to anonymity in the WFP and recognizing the right to knowledge
of genetic origins in order to demonstrate that the dignity of the human person is an
absolute principle.
