La apelación a la ciencia en el gobierno y gestión de la crisis del COVID-19

Abstract

La crisis del COVID-19 ha hecho muy visible un reto que el derecho ya tenía planteado: la decisión en situaciones de incertidumbre científica. Son dos las estrategias que se estaban desarrollando y que están presentes en esta crisis. Una con orientación cientifista y otra sobre referencias internas del derecho. Para que estas estrategias ofrezcan apoyos sólidos a la decisión son condiciones la procedimentalización e institucionalización, sin apelar genéricamente a la ciencia. La proporcionalidad y provisionalidad de las medidas, abiertas a constante revisión, también son condiciones inexcusables. La crisis del COVID-19 muestra que no está bien articulada la relación entre el sistema jurídico y el científico. Algo que sería necesario introducir también en la Constitución mirando al futuro

The COVID-19 crisis has made very visible a challenge that law and politics have already posed: the legal decision in situations of scientific uncertainty. Two strategies were being developed and are present in this crisis. One with a scientific orientation and the other on internal legal references. Both strategies will be fulfilled with procedural and institutional conditions, without generically appealing to science. The proportionality and provisional nature of the measures, which must be open to constant review, are also inexcusable conditions. The COVID-19 crisis shows that the relationship between the legal and scientific systems is not well articulated. This should be also introduced into the Constitution looking to the present future
