A lo largo de la historia, el término “sharía” ha estado sometido a la tensión hermenéutica sobre su significado, deudor de una única mención coránica. Durante siglos, ha sido objeto de manipulaciones ideológicas y políticas que, según las circunstancias, activaban su potencial performativo, prescriptivo o simplemente descriptivo. En este artículo, se analiza a partir de herramientas de la historia conceptual cómo la naturaleza performativa es el distintivo primigenio de la sharía y cómo se ha actualizado en el siglo XXI tras un proceso de estatalización normativa que la había desviado de su capacidad de garantizar la autonomía del individuo. Se parte del concepto de performatividad de Judith Butler como categoría analítica para establecer la inteligibilidad de la sharía y se examinan distintas realizaciones prácticas y propuestas teóricas The word “Sharia” has been historically subjected to hermeneutic tension over its meaning, owing to a single Koranic mention. For centuries, it has been subjected to ideological and political manipulations which, depending on the circumstances, activated its performative, prescriptive or simply descriptive potential. This paper analyzes with skills from the conceptual history how the performative nature is the primary hallmark of the Sharia and how it has updated in the 21st century after a process of normative statization that had diverted it from its ability to guarantee the autonomy of the individual. It starts with Judith Butler's concept of performativity as an analytical category to establish the intelligibility of the Sharia and examines different achievements and theoretical proposals
