Regulación y aplicación del sistema disciplinario de los alumnos universitarios

Abstract

El régimen disciplinario de los alumnos de las Universidades públicas se encuentra en una norma reglamentaria preconstitucional que por muchas razones resulta deficiente e inadecuada a la situación actual. Se da noticia de algunos intentos de sustituirla por una regulación más apropiada. También se exponen los remedios que, ante los fracasos de esos intentos, han ideado algunas Universidades para sortear las dificultades que la aplicación de aquella norma añeja suscita en la actualidad. Finalmente se aborda el ámbito subjetivo y no territorial que ha de darse a este régimen universitario atendiendo al significado y finalidad general de esta potestad disciplinaria y a su concurrencia con otras normas punitivas

The disciplinary regime of students in public Universities is established in a preconstitutional bylaw, which, for many reasons, is deficient and inadequate to the current situation. This paper analyses some of the unsuccessful attempts that have been made to replace it by a more suitable regulation. It also deals with the solutions proposed by some Universities in order to face the problems caused by the difficult application of the old bylaw. The final part of the paper is devoted to the study of the subjective (but not territorial) scope of university regimen taking into account the meaning ang general purpose of this disciplinary power and its relation with other sanctioning norms
