Crítica a la prórroga forzosa desde una perspectiva comparada

Abstract

El propósito de este trabajo consiste en analizar críticamente la prórroga forzosa. A estos efectos, se incorporarán las actualizaciones que serían oportunas en aquellos casos en los que el Derecho Comparado del Reino Unido, Francia y Bélgica alumbra posibles soluciones. Este recorrido analítico se iniciará atendiendo al régimen jurídico de la prórroga forzosa, y en particular en su objeto, sujetos y contenido contractual. Asimismo, se prestará una especial atención a las excepciones a la prórroga forzosa como moderación y ajuste en su aplicación. Estas excepciones versan sobre comportamientos negativos imputables al arrendador y al arrendatario, así como abusos en este régimen privilegiado. Finalmente se incorporarán unas reflexiones finales críticas sobre dicho régimen y la influencia que ha tenido en los arrendamientos urbanos

This paper analyses critically the compulsory extension. The paper argues the appropriation to incorporate some considerations that we found in Comparative Law, particularly of the United Kingdom, France and Belgium. To this end, we analyse the legal framework of the compulsory extension, and in particular its object, subjects and contractual content. Special attention will also be given to exceptions to the compulsory extension as moderation and adjustment in its application. These exceptions deal with negative behaviours attributable to the landlord and the tenant, as well as abuses in this privileged regime. Finally, we make some critical final reflections on this regime and the influence that has had on urban leases
