El sistema de alertas y la prevención de la corrupción desde el punto de vista policial-judicial

Abstract

La implantación de un sistema de alertas en la administración pública se presenta como una herramienta necesaria dentro de los usos preventivos para la evitación de prácticas corruptas. No obstante, la sola implantación del sistema, aun considerando que es una herramienta eficaz, no lo será sin el adecuado control humano, que deberá analizar también aquellos casos que han sido objeto alerta pero aún así no deben considerarse irregulares. Asimismo es preciso que exista algún sistema de retroalimentación, que permita ir modificando el sistema de alertas, cuando determinados casos hayan pasado desapercibidos. De igual forma, la previsión de los sistemas prevención-reacción, tampoco debe permanecer ajena a las motivaciones que mueven a las personas para cometer actos de corrupción, tanto desde la perspectiva del sujeto activo como del pasivo de la acción. Finalmente, desde el punto de vista de la prevención y especialmente el de la transparencia, se antoja trascendental mantener un mínimo control de las conductas de las personas con especial responsabilidad

The implementation of an early warning system in the public administration should be regarded as a necessary tool within the preventive uses to avoid corrupt practices. Notwithstanding, the sole implementation of this system, even considering it as an effective tool, will not be such without the appropriate human control, that has to analyze those cases which are the subject of alert but still mustn´t consider as irregular. Also is necessary to include a feedback system that allows to modify progressively the system when particular cases have passed unnoticed. Likewise, the prevision of the systems prevention-response, either mustn´t remain aloof to the motivations that moves the people to commit acts of corruption, from both the perspective of the active subject of the action to the passive. Finally, from the perspective of the prevention and specially of transparency, it seems necessary to maintain a minimum control of the behaviors of the people with special responsibility
