La prohibición de indultar a los corruptos: ¿Medida con valor real o aparente?

Abstract

En la lucha contra la corrupción la institución del indulto se nos presenta como un úl-timo aliado de aquellos sujetos que, abusando de su posición, orientan la prestación de ser-vicio público a su propio beneficio. El control y la limitación sobre la concesión de los in-dultos se revela como un elemento clave a la hora de luchar no solo contra la corrupción en sí misma, sino contra la percepción de la misma por parte de la ciudadanía. Para testar la viabilidad de la prohibición será necesario analizar brevemente la institución del indulto y determinar a qué delitos nos referimos cuando hablamos de corrupción. De este análisis de-duciremos los límites y posibilidades de la prohibición expresa, para así poder valorar los argumentos a favor y en contra de la misma, así como las alternativas actuales que pudieran alcanzar los objetivos pretendidos

In the fight against corruption the institution of pardon is presented as a last ally of those subjects who, abusing their position, orient the provision of public service to their own benefit. Control and limitation on the granting of pardons is revealed as a key element in fighting, not only against corruption in itself, but against the perception of it by the citizens. To test the viability of the ban, it will be necessary to briefly analyze the pardon institution and determine what crimes we refer when we speak of corruption. From this analysis we will deduce the limits and possibilities of the express prohibition, in order to be able to eval-uate the arguments in favor and against it, as well as the current alternatives that could achieve the intended objectives
