La pandemia y la libertad de empresa

Abstract

El objeto de este trabajo es analizar desde una perspectiva constitucional el impacto jurídico de la pandemia sobre la libertad de empresa. Se explica en primer lugar cómo entiende el Tribunal Constitucional esta libertad y cómo se sitúa esta en el contexto de los estados excepcionales. Después, se analiza la erosión que ha sufrido la libertad de empresa con las medidas adoptadas en las tres fases por las que ha pasado (y sigue pasando) la crisis sanitaria. Por último, se concluye con unos breves apuntes, a modo de epílogo

The purpose of this paper is to analyze from a constitutional perspective the legal impact of the pandemic on the freedom of enterprise. First, it explains how the Constitutional Court understands this freedom and how it is situated in the context of exceptional states. It then analyzes the erosion suffered by the freedom of enterprise as a result of the measures adopted in the three phases through which the health crisis has passed (and continues to pass). Finally, it concludes with a few brief notes by way of an epilogue
