Una escala de la planificación en atención a la función directiva de los planes. El ejemplo de los planes contra la despoblación

Abstract

En este trabajo se pretende, en primer término, situar el concepto de plan en el contexto de las formas de actuación de la Administración y de las formas jurídicas clásicas que todavía tienen fuerza estructurante de la parte general del Derecho administrativo. Después se ensayará el modelo de una escala de la planificación en atención a la función directiva de los diversos tipos de planes de la práctica administrativa actual; escala que se construye con la ayuda de dos criterios: el “volumen” de la actividad administrativa dirigida por el plan, y la fuerza y la forma de vincular del plan. Para el final quedará, como un ejemplo que se somete al análisis que permite este material teórico, el tratamiento de un conjunto de planes autonómicos contra la despoblación, que se ha considerado suficientemente representativo

This paper intends, first of all, to place the concept of plan in the context of the forms of action (Handlungsformen) of the Administration and of the classic legal forms (Rechtsformen) that still have structuring force in the general part of Administrative Law. Later, the model of a planning scale will be offered and tested in attention to the directive function of the different types of plans of the current administrative practice. This scale is built with the help of two criteria: the “amount” of the administrative activity directed by the plan, and the binding effectiveness of its decisions and the way the plan uses to steer the administrative action. As an example that is submitted to the analysis that this theoretical material allows, a set of regional plans against depopulation, which has been considered sufficiently representative, will finally be examined
