Abstract

This paper deals with the functions that the judicial bodies can assume beyond what is their function par excellence: to judge and to enforce what is judged. This issue is addressed in view of the reforms made in the Administrative Justice Act to control the measures passed in the face of the covid-19 pandemic. To this end, this paper carries out a constitutional analysis of the functions that can be attributed to the judicial bodies based on Article 117(4) Spanish Constitution from the systema-tics of articles 24, 103, 106, 117 and 123 Spanish Constitution considering the Constitutional Court Judgment 70/2022

Este trabajo analiza las funciones que los órganos judiciales pueden asumir más allá de la que es su función por antonomasia: juzgar y hacer ejecutar lo juzgado. Se aborda esta cuestión en el marco de las modificaciones habidas en la LJCA para abordar el control de las medidas aprobadas frente a la pandemia de la covid-19. A tal efecto se realiza un análisis constitucional de las funciones que pueden ser atribuidas a los órganos judiciales con base en el art. 117.4 CE desde la sistemática de los arts. 24, 103, 106, 117 y 123 CE a la luz de la STC 70/2022
