El nuevo Reglamento (UE) 2019/1111 en materia matrimonial, responsabilidad parental y sustracción internacional de menores

Casi veinte años después del primer Reglamento procesal en materia de familia,
Bruselas II, el legislador europeo presenta el Reglamento (UE) 2019/1111,
refundición del texto actualmente en vigor, el Reglamento (CE) 2201/2203
(RBIIbis), para adaptarlo a las necesidades observadas tras su aplicación. El
Reglamento Bruselas IIter incorpora parte de la jurisprudencia del Tribunal de
Justicia en interpretación de las disposiciones del RBIIbis, al tiempo que alinea
algunas de las soluciones con las de otros textos internacionales, en particular
con dos Convenios de La Haya, de 1980 y 1996, en materias cuyo ámbito de
aplicación se solapa con el del Reglamento. El nuevo texto, además, uniformiza
algunas de sus reglas con las de otros Reglamentos procesales de la UE,
construyendo un sistema procesal europeo más coherente. Todo ello resulta en
un Reglamento más intuitivo, aunque no necesariamente más sencillo, si esta
era una finalidad perseguida por el legislador europeo Almost twenty years after the first EC Regulation (Brussels II) on family matters,
the Regulation (EU) 2019/1111 has seen the light. This text recasts Regulation
(EC) 2201/2003 with the purpose to improve its rules once they have been
tested by their application. Many decisions of the CJEU in interpretation of the
Regulation (EC) 2201/2003 have been incorporated into the Recast Regulation.
One may also acknowledge an alignment of its solutions with those of two other
international Conventions, The Hague Convention 1980 and The Hague
Convention 1996, whose scope of application overlap with the Regulation’s.
Lastly, some of the rules in the Recast Regulation are harmonised with other
European Regulations dealing with procedural matters, which results in a more
coherent system of European (international) procedural law. As a result, the
Recast is more intuitive —but not necessarily simpler, if this was an aim pursued
by the European legislature— than Regulation 2201/2003
